This is the Delaware Superior Court's prescribed form for a motion for postconviction relief under Criminal Rule 61, revised March 2016. The instructions require it to be legibly handwritten or typewritten and signed under penalty of perjury, state that additional pages are not permitted and that the reverse of the sheet should be used if more room is needed, and direct that legal arguments go in a separate memorandum. Only convictions included in the same plea agreement or tried together may be challenged in a single motion. The completed original is mailed with no fee to the Prothonotary in the county of conviction: New Castle County at 500 North King Street Suite 500, Wilmington; Kent County at 38 The Green, Dover; or Sussex County at 1 The Circle Suite 2, Georgetown. The form warns that failing to state every ground may bar raising additional grounds later, and lists common grounds such as coerced confession or guilty plea, suppression of favorable evidence, ineffective assistance of counsel and an unfulfilled plea agreement.
